Gift tax annual exclusion ($19,000 in 2026)

$19,000 per recipient· Tax rule

Law or rule (2026)Set by statute, regulation or the agency; numbers change yearly.

You can give up to $19,000 per recipient in 2026 without filing a gift tax return or using lifetime exemption.

See it on the Personal Finance & Estate map →

How it works

The limit is per giver, per recipient, per year; a married couple can give $38,000 to anyone; if one spouse supplies all the money, they elect gift-splitting on Form 709. Unused amounts don't carry over. Gifts must be 'present interests', usable now; gifts into trusts usually need Crummey withdrawal rights to qualify. Separately, tuition and medical bills paid directly to the school or provider are unlimited. Gifted property keeps your basis, so cash or high-basis assets often make better gifts than low-basis real estate.

Why it matters for you

Steady yearly gifts move substantial wealth out of an estate with no tax, but Medi-Cal ignores the exclusion and can still penalize them.

Think of it like

Like a yearly use-it-or-lose-it allowance: unused amounts never roll over.

Rules, limits and sources (2026)

IRC Sec. 2503(b); it began at $5,000 in 1932 and has been inflation-indexed under a 1997 law; IRS Rev. Proc. 2025-32 kept 2026 at $19,000.

Watch out for

Courts still test when gifts of LLC or trust interests count as present interests, as in the 2002-03 Hackl case.

▸Gift tax annual exclusion ($19,000 in 2026) is the yearly free pass in Federal estate & gift tax (unified; California has none)Law or rule (2026)

How they connect

Under the unified estate and gift tax, every taxable gift uses up lifetime exemption. The annual exclusion is the carve-out: gifts up to $19,000 per recipient each year don't count at all and never touch the $15 million exemption. Gifts above it go on Form 709 and reduce the exemption, usually with no tax due.

When it applies

Congress set the exclusion at $5,000 when it restored the gift tax in 1932; it was $3,000 for decades, then $10,000 from 1982.

The rule

IRC Sec. 2503(b) defines the exclusion; Sec. 2505 applies taxable gifts against the unified credit.

Watch out for

With so few estates taxed, some argue the exclusion now matters less for tax than for Medi-Cal and family dynamics.

▸Form 709 (gift tax return) reports gifts above Gift tax annual exclusion ($19,000 in 2026)Law or rule (2026)

How they connect

The annual exclusion sets the reporting line: gifts to one person up to $19,000 in 2026 need no return. Give more, split gifts with a spouse, or give future interests, and the giver files Form 709. The return subtracts the exclusion and applies the rest against the lifetime exemption.

When it applies

Filed with the IRS by April 15 of the year after the gift; the filing duty has been tied to the exclusion since 1932.

The rule

IRC Sec. 6019 requires a return for gifts beyond the exclusion; IRS Form 709 instructions list the triggers.

Watch out for

Many people who should file don't; how often the IRS catches unfiled gifts, such as below-market sales to children, is unknown.

▸Medicaid (Medi-Cal) planning & the look-back period can penalize gifts that fit under Gift tax annual exclusion ($19,000 in 2026)Watch out

How they connect

The $19,000 annual exclusion is a federal gift-tax rule only; Medi-Cal ignores it. Since January 2026, gifts made within the 30-month look-back before applying for nursing-home Medi-Cal can trigger a penalty period without coverage, even if gift-tax-free. Protect parents: document every gift and see an elder-law attorney before giving.

When it applies

California dropped its asset test and look-back in 2024, then restored both in January 2026; federal law sets a 60-month look-back elsewhere.

How sure?

California's Welfare and Institutions Code and DHCS guidance; the federal Deficit Reduction Act of 2005 set the national 60-month rule.

Watch out for

How DHCS will treat gifts made in 2024–25, when no look-back applied, and some exempt transfers, such as to a caregiver child, are still settling.

▸Family LLC / family limited partnership is gifted in slices using Gift tax annual exclusion ($19,000 in 2026)Depends on you

How they connect

Parents put property into an LLC, then give children small LLC units each year. Because minority, non-voting units can't control or easily sell, appraisers discount them, often 20–40%, so $19,000 of exclusion moves more underlying value. Trap: units must carry real present rights, or the IRS denies the exclusion.

When it applies

Common since the 1990s; the Tax Court's 2002 Hackl decision, affirmed in 2003, denied exclusions for LLC gifts without present rights.

How sure?

IRC Sec. 2503(b); Hackl v. Commissioner (7th Cir. 2003); Price (2010) and Fisher (2010) followed it.

Watch out for

Discount sizes are constantly litigated; Treasury proposed curbing them in 2016 but withdrew the rules in 2017. Ask an estate attorney and appraiser.

▸Gift tax annual exclusion ($19,000 in 2026) can be superfunded into 529 college savings plan (ScholarShare in CA)Law or rule (2026)

How they connect

A special election lets a giver front-load five years of annual exclusions into a 529 at once: $95,000 per beneficiary in 2026, or $190,000 from a married couple, without using lifetime exemption. If the giver dies within five years, part comes back into the estate.

When it applies

Allowed since the late 1990s; elected on a Form 709 gift-tax return, most often by grandparents and parents.

The rule

IRC Sec. 529(c)(2)(B); Form 709 instructions; the 2026 annual exclusion is $19,000 per recipient.

Watch out for

Since the 2024 FAFSA overhaul, grandparent 529 payouts no longer count against federal aid, but colleges using the CSS Profile may still count them.
