Benefit formula: 40 credits, top 35 years, AIME & PIA

Since 1977 law· Concept or strategy

Law or rule (2026)Set by statute, regulation or the agency; numbers change yearly.

How SSA turns your earnings history into a monthly benefit: 40 credits to qualify, then your top 35 years, averaged and tiered.

See it on the Personal Finance & Estate map →

How it works

You qualify after 40 credits; in 2026 you earn one credit per $1,890 of wages or self-employment income, up to four a year. SSA indexes past earnings to national wage growth, averages your highest 35 years into a monthly figure (AIME), and counts missing years as zero. Your full benefit (the PIA) is 90% of the first $1,286 of AIME, 32% of AIME up to $7,749, and 15% above that. Only earnings up to the wage cap count.

Why it matters for you

The tiers replace a bigger share of a low earner's pay; each extra working year can replace a zero, and rental income earns no credits at all.

Think of it like

Like income-tax brackets in reverse: the first dollars of average earnings count most, later dollars count least.

Rules, limits and sources (2026)

Set by the Social Security Amendments of 1977, which fixed a flawed 1972 inflation formula. The tier cutoffs ('bend points') update yearly; your Social Security Statement shows your recorded earnings.

Watch out for

Reform plans often target this formula, for example trimming the top tier or averaging 38 to 40 years; none has passed.

Connections (2)

▸Benefit formula: 40 credits, top 35 years, AIME & PIA sets each check in Social Security (OASDI)Law or rule (2026)

How they connect

The formula turns your earnings record into your primary insurance amount (PIA), the base for every check paid on your record: your own, your spouse's, your survivors' and disability payments. Claiming age then scales that base up or down.

When it applies

Adopted in the Social Security Amendments of 1977, signed by Jimmy Carter, and applied to workers turning 62 from 1979 on.

The rule

Section 215 of the Social Security Act defines it; SSA's online calculators and your Statement apply it to your own record.

Watch out for

Whether 35 years is the right averaging span, and whether the top tier should shrink for high earners, are standing reform questions.

▸WEP/GPO repeal (Social Security Fairness Act) removed pension-based reductions from Benefit formula: 40 credits, top 35 years, AIME & PIALaw or rule (2026)

How they connect

WEP replaced the formula's first 90% tier with as little as 40% for workers with non-covered pensions, and GPO cut their spousal and survivor benefits. Repeal restored the standard formula for them, raising checks by hundreds of dollars a month for many.

When it applies

Signed January 5, 2025, effective for benefits from January 2024; SSA finished most retroactive payments by July 2025.

The rule

Public Law 118-273 and SSA's implementation notices; affected beneficiaries received letters and back-pay deposits.

Watch out for

Some say WEP's crude 40% fix was unfair but repeal overcorrects for short-career workers; a proportional formula was proposed but not adopted.
