EBSA, part of the U.S. Department of Labor, enforces ERISA for private-sector workplace benefits: 401(k)s, pensions, and employer health and disability plans. It audits plans, reviews annual Form 5500 filings, sues fiduciaries who mismanage money or charge excessive fees, and helps individuals recover denied benefits. The IRS shares the work, policing plans' tax rules. Government and church plans, and ordinary IRAs, fall outside its main reach.
Why it matters for you
If an employer stops depositing 401(k) contributions or a plan wrongly denies a claim, EBSA is the free place to complain. Its fiduciary rules shape what advice retirement savers get.
Rules, limits and sources (2026)
EBSA's annual enforcement fact sheets report recovering more than $1 billion a year for plans and participants through investigations and its benefits advisors.
Watch out for
Its 'fiduciary rule' on retirement advice keeps flip-flopping: a 2016 rule was struck down in 2018, a 2024 version was paused by courts, and the 2025 administration is reconsidering.

▸U.S. Dept. of Labor, Employee Benefits Security Admin. is the workplace-benefits watchdog among Financial & consumer regulatorsLaw or rule (2026)
How they connect
Among the regulators, EBSA's turf is benefits you get through work: 401(k)s, pensions and employer health plans. The SEC regulates the funds inside a 401(k) and the IRS its tax status, but EBSA polices the people running the plan: fees, investment choices, timely deposits and claim denials.
When it applies
ERISA (1974) gave the Labor Department this role; the office took the Employee Benefits Security Administration name in 2003.
The rule
ERISA Title I assigns enforcement to Labor; EBSA publishes its enforcement statistics and court cases every year.
Watch out for
Overlap with the SEC and states over retirement advice, especially IRA rollovers, keeps producing turf fights and lawsuits.
▸Pension Benefit Guaranty Corporation (PBGC) works alongside U.S. Dept. of Labor, Employee Benefits Security Admin.Law or rule (2026)
How they connect
Both were born of ERISA. EBSA enforces the rules for running pensions and other plans, while the PBGC insures defined-benefit pensions if they fail. The Labor Secretary chairs PBGC's board, with the Treasury and Commerce secretaries, and the annual Form 5500 filing feeds both agencies' oversight.
When it applies
Both trace to ERISA, signed on Labor Day 1974; PBGC began insuring pensions that year as a federal corporation.
The rule
ERISA Title IV creates the PBGC with the Labor Secretary as board chair; Form 5500 is a joint Labor-IRS-PBGC filing.
Watch out for
Whether PBGC premiums and funding rules are too heavy, pushing employers to freeze or drop pensions, or too light to protect workers, is debated.
▸ERISA (Employee Retirement Income Security Act) is enforced by U.S. Dept. of Labor, Employee Benefits Security Admin.Law or rule (2026)
How they connect
ERISA's Title I sets fiduciary, reporting, disclosure and claims rules for private-sector plans and gives EBSA the power to investigate and sue. The IRS enforces ERISA's tax-qualification side and the PBGC its pension insurance. Participants can also sue directly, and EBSA often files friend-of-court briefs supporting them.
When it applies
Signed by President Ford in 1974; the Labor Department's benefits office got its EBSA name in 2003.
The rule
ERISA Secs. 502 and 504 authorize Labor investigations and lawsuits; EBSA's yearly enforcement fact sheets list cases and recoveries.
Watch out for
How strictly courts read ERISA's fiduciary duties in 401(k) fee lawsuits keeps shifting; the Supreme Court's 2025 Cunningham v. Cornell ruling made such suits easier to bring.
▸U.S. Dept. of Labor, Employee Benefits Security Admin. oversees fiduciaries of 401(k) planLaw or rule (2026)
How they connect
EBSA enforces ERISA's fiduciary rules for 401(k)s: employers and plan committees must choose and monitor investments prudently, keep fees reasonable, deposit employee deferrals promptly, and avoid self-dealing. It investigates, can force restitution, and requires fee disclosures to participants.
When it applies
Washington and regional offices; participant fee-disclosure rules took effect in 2012; employers file Form 5500 yearly with the DOL and IRS.
The rule
ERISA Title I and DOL regulations (Sec. 2550.404a-5 fee disclosures); EBSA's yearly enforcement reports list monetary recoveries.
Watch out for
The Labor Department's rule on when rollover advice counts as fiduciary advice has been rewritten and blocked in court repeatedly since 2016.
