See it on the Personal Finance & Estate map →How it works
The California Department of Insurance, led by an elected Insurance Commissioner since Proposition 103 (1988), licenses insurers and agents, must approve home and auto rate changes, and investigates insurance fraud. It regulates life insurance, annuities and long-term care policies sold in the state and runs a consumer hotline for claim disputes. Its free Life Policy Locator asks insurers to search for a deceased relative's forgotten policies.
Why it matters for you
It is where to verify an agent's license before buying an annuity or long-term care policy, and where to complain about a denied claim. Its wildfire-era rules shape home insurance availability.
Rules, limits and sources (2026)
Prop 103's rate approval rules are in Insurance Code Sec. 1861.01 and following; the department posts license lookups, complaint statistics and enforcement actions online.
Watch out for
Whether its 2024–25 Sustainable Insurance Strategy, letting insurers price in wildfire models and reinsurance costs in exchange for writing in high-risk areas, will bring insurers back is unsettled.

▸California Department of Insurance is the insurance watchdog among Financial & consumer regulatorsLaw or rule (2026)
How they connect
Insurance is regulated by states, not Washington, so in California the Department of Insurance plays the role the SEC plays for securities. It covers life, property, long-term care and fixed and indexed annuities, plus some health policies; most HMO-style health plans answer to a separate Department of Managed Health Care.
When it applies
The McCarran-Ferguson Act of 1945 left insurance regulation to the states; California's department dates to 1868.
The rule
McCarran-Ferguson and the California Insurance Code define its authority; it coordinates model rules through the National Association of Insurance Commissioners.
Watch out for
Whether state-by-state oversight can handle climate-driven losses like wildfire, or needs a federal role, is debated.
▸Annuities (immediate, deferred, fixed-indexed, variable) are regulated by California Department of InsuranceLaw or rule (2026)
How they connect
Annuities are insurance contracts, so the Department of Insurance licenses the agents who sell them, approves the products and enforces sales rules, including best-interest standards and a 30-day free look for buyers 60 and older. Variable annuities are also securities, adding SEC and FINRA oversight. If an insurer fails, a state guaranty association covers contracts up to limits.
When it applies
California moved annuity sales to a best-interest standard by 2023 legislation; the seniors' 30-day free look is in Insurance Code Sec. 10127.10.
The rule
The department's enforcement actions against agents for elder annuity abuse are public, as are agent license records on its website.
Watch out for
Whether best-interest rules, which stop short of a full fiduciary duty, actually curb high-commission sales to seniors is still being evaluated.
